Statment
Friday-ad sl is a sister company of Friday-ad ltd an advertising paper and classified website founded in the UK in 1975. In 2003 Friday-ad was set up in the Costa del Sol. The Costa del Sol operation consists of a weekly classified publication that is distributed throughout the region and a classified website www.Friday-ad.es .
Tracy Daley’s employment at Friday-ad:

As her role grew Tracy undertook the extra roles of.
• Payroll (Tracy was given Power of attorney to sign cheques)
• Attendance
• Co-ordination of the relationship between the sales teams and Studio.
Everything Tracy had done up until then had suggested she was capable and trustworthy. Trust was a key dynamic in the relationship between Friday-ad Spain and Friday-ad UK. Due to the remoteness of the operation total transparency is not always a possibility so in appointing Tracy as management it was important that we felt they would always work in the best interests of Friday-ad in Spain
For the first year the new management structure appeared to be running smoothly. The one concern was the levels of doubtful and bad debt that grew as turnover grew. In the advertising industry debt and late payment is not an uncommon problem; however levels of debt in Spain were above what the company had ever experienced in the UK. We attempted to address the problem through tighter credit control for account customers and by demanding prepayment for new customers and clients with a poor credit history. Levels of debt decreased however by early 2008 the problem had resurfaced.
Early 2008 when signs of discontent first emerged in the Spanish office. The source was Tracy’s behaviour. Issues were not initially raised with management in the UK
Issues included:
• Regular poor attendance
• Leaving the office early
• Bullying staff
• Mood swings
Levels of bad debt continued however – the cause was put down to poor collection and poor management as well as the economy (At this time the recession was starting to bite and a few of our account customers had gone out of business leaving unpaid invoices). During his visit in May 2008 The Management made Tracy totally accountable for managing debt and keeping it to a minimum. We had made provisions for bad debt in our budget and Tracy was informed that if she came in over budget she’d be paid an additional bonus of €200 per month. This was seen as a way of incentivising and managing collection. She was also told that if collection and payment terms were not adhered to she would be accountable.
It is at this stage that I believe Tracy betrayed our trust. Perhaps she saw the debt levels as a way of masking fraudulent activity.
2008 and January 2009 Tracy regularly stole from Friday-ad for her own gain. Between November and January investigations in the UK were carried out that suggested fraudulent activity was being carried out. In late January enough evidence had been collected to suspend Tracy. The manager travelled to Spain on ..,…….. Carry out a disciplinary and suspended her having taking advice from our accountants and solicitors Bocanegra SL. Further investigations post Tracy Daley’s departure uncovered further discrepancies.
To summarise: - Tracy was in a position of trust. The company had to trust her as we were unable to operate as transparently as we would have liked due to the remoteness of our Spanish business. In hindsight she was probably given too much responsibility and since her dismissal internal auditing has been improved.
